Hit in a Parking Lot by an Elderly Driver

Sarah was walking to her car in a parking lot. An elderly driver began to back up his car and pinned her between his car and her car, thereby severely fracturing her arm. The fracture required open reduction internal fixation surgery whereby she had surgical hardware installed inside of her arm.
The liability in this case was not at issue, but the elderly driver's insurance company did not want to pay the significant damages which we claimed her case was worth. The case was litigated and the defense counsel finally agreed to submit the case to alternative dispute resolution.
We presented a very strong case to the retired judge, who heard arguments from both parties, and the judge was able to convince the defense counsel of the great worth of this case. At that point, we resolved this matter prior to trial for a significant amount of money. Our client was very happy with the outcome.
