Collecting Money Damages in a Connecticut Car Accident Involving a Minor Impact

Posted by Richard P. Hastings | Nov 30, 2017 | 0 Comments

One very difficult type of Connecticut car accident case is one that involves a minor impact. A minor impact case is one in which there is little visible damage to the motor vehicle and the repair estimate is relatively minor. Insurance companies love to show that because there was little to no damage to a motor vehicle and because the damage estimate is low then the person inside the motor vehicle could not have been injured that badly or perhaps not even injured at all. These cases present problems for Connecticut car accident lawyers in that it is sometimes difficult to connect the injuries and damages suffered by the accident victim to the minor impact of the car accident.

Our Connecticut car accident lawyers were contacted by a woman who was involved in a minor impact car accident. There was a great concern that because this was a minor impact that the amount of money damages that she could recover would be limited. She met with our lawyers who conducted a detailed intake of her case, reviewed the pictures of the vehicles involved in the accident, reviewed her motor vehicle damage estimate, went over her medical history, which included a prior back injury, and discussed the findings of her doctors as it related to her current car accident.

Our Connecticut car accident lawyers then agreed to take her case. We had her sign a retainer agreement with our firm whereby we accepted this case on a contingency fee basis and agreed to advance the costs to develop her case.

We then went about developing her case. We followed up with her doctors to amass her medical bills, records and reports. We stayed in constant contact with our client. We answered all of her questions on a timely basis. We provided all of this information to the insurance adjuster on a very regular basis.

Once she concluded all of her medical treatments for her accident related injuries, we met with our client and put together a detailed settlement demand package. We then provided this comprehensive document to the insurance company of the person that caused the accident. After an extended period of negotiation, the insurance company did not feel that our client's case was worth our demand of the policy limits which was six figures. It was then suggested that we attend a mediation, where a professional mediator was provided with summaries by both our injury lawyers and the defense lawyers representing the insurance company. After many hours of mediation and follow-up calls after the mediation, we were able to resolve this case in our client's favor for the full policy limits.

Naturally, our client was thrilled that we were able to get every penny available to her. She was so pleased with the result that she provided us with a wonderful testimonial thanking us for all of our hard work and the fantastic result which we obtain for her. Interestingly, this client was referred to us by her daughter who we previously represented in a car accident case. We find that many of our new personal injury clients come to us as a result of referrals from prior clients because they were so happy with our representation of them and know that we will do a good job for their friends and family members. Other clients come to us as a result of the testimonials which they read on her website where our former clients rave about our services, the information we provide to them, the fact that we are very accessible, and most importantly in the results that we are able to obtain for our injured clients.
